TERMS AND CONDITIONS
1) In General
1.1) Access to and use of this website and the products and services available through this website www.kiyanawraps.com (collectively, the "Site") are subject to the following Terms, Conditions and Notices of Sales (hereinafter the "Terms of Service"). The goods displayed on the Site are offered on sale exclusively to individuals above the age of consent.
1.2) By using the services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service. Reselling, rental or disposal for any commercial or professional purposes of products purchased from the site is expressly forbidden.
1.3) KIYANA LTD may modify or amend these Terms and Conditions at any moment. You are therefore asked to accept only the Terms and Conditions applicable at the time of purchase with each of your orders.
3.1) You must not misuse this website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. KIYANA WRAPS will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
3.2) We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this website or to your downloading of any material posted on it, or on any website linked to it.
4) Terms of Sales
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.
In order to contract with KIYANA LTD you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. KIYANA LTD retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.
5.1) For each product selected, you can view a web space featuring photograph of the item, its unit price, its colours, designs and sizes (if applicable).
5.2) You choose the items you are interested in, and the description of the goods being sold, including the relative measures or size (if applicable), jointly to one or more digitalized photographic images allowing a correct viewing of the good itself available on the site, will be included in your Shopping Cart.
5.3) Click on the Shopping Cart icon to view the items you have selected and the total price of your order. Check that the contents of the Shopping Cart are correct before confirming your order completing the purchase form according to the instructions provided on the relevant page of the site and confirming that you read and agreed on these Terms and Conditions.
5.4) should you need to amend (e.g. item or number of items) or correct any error on your order, you will have to follow the instructions contained on the Site.
5.5) At the end of the purchase procedure, we recommend to download, save or print out the Terms and Conditions applicable at the time of completion of your order. You will also receive an e-mail at the address you entered in the purchase form, confirming the main conditions of your purchase.
5.6) While KIYANA LTD continues to make every effort to ensure that the photographs displayed on the site are faithful reproductions of the original products, including adopting every technological solution possible to minimize inaccuracies, variations may occur due to the technical and colour resolution characteristics of your computer. KIYANA LTD shall not be liable therefore for the eventual inadequacy of the graphic representations of KIYANA WRAPS products displayed on the site owing to the above mentioned technical issues.
5.7) KIYANA LTD reserves the right to reject orders from any customer with whom there is an ongoing legal dispute regarding a prior order. This applies equally to all cases in which KIYANA LTD considers the customer unsuitable, for instance in the case of previous violations of Terms and Conditions for online purchases on the Site or for whatever other legitimate reason, especially where the customer has been involved in fraudulent activity of any kind.
6.1) You acknowledge that the products offered by KIYANA LTD through its brand KIYANA WRAPS with the Site are subject to stock limits. You may check the availability of any item offered on the Site at any time, either while creating your Shopping Cart or after completing your order.
6.2) You cannot order a product by loading your Shopping Cart and saving it for purchase at a later Internet session. Unless you fully complete the order procedure, the contents of your Shopping Cart will be lost without trace at the end of each shopping session.
6.3) Inconveniences may occasionally occur regarding the availability of certain products. In such circumstances, we will inform you of this fact as soon as possible (and in any case within the Term of Delivery as specified below) by e-mail or telephone. We will give you the option to order a different item of the same type or alternatively, to cancel your order if you have already paid for it. Should you opt to cancel your order no charge will be made to your credit or debit card. In the event that your credit or debit card has already been charged, you will be refunded as soon as possible.
6.4) KIYANA LTD reserves the right to change the items offered on the site at any moment, without prior notice.
7) Completing an order
7.1) The order procedure is completed when you select the "Confirm" option. Upon confirmation, your order will be submitted to KIYANA LTD for processing and may not be changed or cancelled except as expressly provided in these Terms and Conditions or as required by the applicable UK law.
7.2) Confirmation of your order will be taken as proof of your acceptance of the provisions contained in these Terms and Conditions.
7.3) The data recorded on the Site shall be treated as conclusive evidence of the details of the transactions between KIYANA LTD through its brand KIYANA WRAPS and the customer. In the event of a dispute between KIYANA LTD and the customer relating to a transaction conducted on the Site, the data recorded by KIYANA LTD shall be treated as legal evidence of the transaction.
8) Price and Method of Payment
8.1) The prices of all products offered on the site are inclusive of VAT
8.2) The total amount shown includes shipping costs, as detailed below and displayed on the Shopping Cart.
8.3) KIYANA WRAPS reserves the right to change the prices of the products offered on its Site at any moment and without prior notice. You will be charged the prices displayed on the Site at time your order is confirmed, provided that the products ordered are available at that time.
8.4) KIYANA WRAPS accepts payments by PayPal, credit and debit cards. We accept the following credit and debit cards:
For United Kingdom: Visa® - Visa Electron® - MasterCard® - American Express® - Solo® - Maestro® PayPal.
8.5) You can also make cash payment directly into our bank account or by BACS transfer, contact us for bank details and procedures when making payments in this way: firstname.lastname@example.org
8.6) Your order will only be dispatched once we have verified your credit or debit card data with the bank and received authorization to debit your card. Your credit or debit card will only be debited after your order is dispatched.
9) Delivery Limitations
The products will be dispatched only to the card holder’s billing address. Immediate payment will be required at the point of checkout when placing an order to secure your goods.
For security reasons, KIYANA WRAPS ships to P.O. Boxes (at your own risk, as orders cannot be tracked and signed, addresses are unverifiable).
10) Shipping Costs
10.1) Standard orders will be processed within 24 hours and dispatched within 3-5 working days dependent on availability and the time of the day the order was placed. Some items may be made to order.
10.2) There may be some instances where your order may be delayed and delivery will take longer than expected, such as awaiting stock delivery if the product(s) ordered are out of stock, computer error(s) or other circumstances. In the event of any delay in delivery KIYANA WRAPS will contact you by email or telephone (for UK customers only).
10.3) All UK delivery is sent via Royal Mail First Class Recorded Delivery from £8 (3 - 5 working days). For urgent orders we offer Royal Mail Special Delivery Next Day £11.00 - £20.00. Orders must be placed before 1pm Monday to Friday.
10.4) Other International delivery (including the Channel Island) is sent via Royal Mail International Signed For post £16.00 - £20.00 GBP (up to 14 working days). Some International orders may incur extra charges which are beyond our control.
11) Conformity of Orders
11.1) Goods must be checked at the moment of delivery to make sure they correspond to the items ordered.
11.2) Any eventual anomalies found at delivery (e.g. interference or damage to the packing, damaged goods, missing items with respect to the waybill, etc.) may be indicated directly on the delivery note in a handwritten comment signed by the customer.
11.3) If the goods do not correspond to the ordered products the customer must promptly notice KIYANA WRAPS at the e-mail address customercare@Kiyanawraps.com and has the right to ask for the conformity of the order, or in case of any unavailability of the ordered products occurred in the meanwhile, to order a different item of the same type, or alternatively, to cancel the order. Should the customer opt to cancel their order no charge will be made to their credit or debit card. In the event that their credit or debit card has already been charged, the customer will be refunded as soon as possible.
12) Returns and Refunds - Cancellation
Our aim is to ensure that you have the best shopping experience possible. All our KIYANA WRAPS headpieces are of the highest quality and each one is handmade to order at our studio in London. However, due to the bespoke nature of some of our products, we place restrictions on certain refunds and exchanges:
12.1) Refunds or exchanges are available on products that arrive damaged or if the product shipped does not fit the recipient.
12.2) Refunds are not available for any other reason or purpose. Exchanges are available for alternative headdress and cap sizes.
12.3) Refund or exchange requests must be received within 3 (three) working days of purchase confirmation. The cancellation period, in accordance with EU Distance Selling Regulations, ends on the expiry of the period of 7 (seven) working days beginning with the day after the day on which you received the goods.
12.4) Refund or exchange requests must be made by e-mail at email@example.com. The customer is responsible for all costs associated with returning the product back to KIYANA WRAPS unworn and in saleable condition, and must include all original boxes and packaging.
13) Returns and Refunds - Procedure
13.1) Cancellation of customer orders and claims for returns and refund regarding any item purchased on the site must be made in the following way:
a) Claims concerning possible returns of goods must be made within 3 (three) working days from the delivery date of the items to the customer by means of a request to be sent to the following e-mail address: firstname.lastname@example.org
b) The customer must fill in and send the 'Return card' included with the package of your order specifying the reason for return and the quantity of the items that you wish to return. Such “Return card” has to be included in the return parcel.
13.2) KIYANA LTD will verify whether the returned products are effectively in original condition, unworn and in perfect condition. KIYANA LTD shall not be liable for any item returned being lost, misdirected or delivered late, the customer assuming all shipping risks.
14) Liability for defective goods
14.1) Replacements for exchange of damaged goods will not be dispatched until the original item has been received to our studio.
14.2) KIYANA WRAPS does not give refunds on the following items: Unwanted items returned after 7 (seven) days, items without a completed returns form, damaged items not notified by email or telephone to us within 3 (three) working days. All Bespoke items, made to order items and Gift Vouchers.
15) Limitation of liability
KIYANA LTD through its brand KIYANA WRAPS shall not be liable for any indirect or consequential damages and, in particular, shall accept no liability.
